Privacy Notice

Song Request Live (“SRL”, “we”, “us”, or “the service”) respects your privacy. This Privacy Notice explains the information we collect and process, how we use it, when it may be shared, and the choices available to you.

Information We Collect & Process

Depending on how you use SRL, we may collect or process information including:

Account information, such as your username, email address, account identifiers, subscription level, and account settings.
Performer and profile information you choose to provide, including performer names, profile information, images, payment links, and Gig Profile information.
Song and performance information, including song lists, setlists, Song Notes, request categories, performance settings, and related information used to operate SRL.
Uploaded content, which may include chord sheets, PDFs, documents, images, back tracks, performance notes, and other materials you choose to submit to SRL.
Subscription and transaction information necessary to administer paid SRL subscriptions, such as subscription status, transaction identifiers, payment status, and related billing records.
Referral and affiliate information when you participate in or use SRL referral or affiliate features.
Communications you send to us, including information submitted through contact forms, support requests, or other communications.
Technical and security information, such as IP addresses, browser or device information, session information, timestamps, page requests, error information, and server or security logs.

How We Use Information

We use information as reasonably necessary to operate and support Song Request Live, including to:

create, maintain, and secure user accounts;
provide song lists, setlists, Song Notes, Gig Profiles, audience requests, tipping links, and other SRL features;
process uploaded materials and perform user-requested imports or conversions;
administer subscriptions, account levels, referrals, and affiliate features;
provide customer support and respond to communications;
maintain the security, reliability, and operation of the service;
detect, investigate, and prevent abuse, fraud, unauthorized access, or security problems;
troubleshoot problems and improve the performance and functionality of SRL;
maintain appropriate business and transaction records;
comply with legal obligations and enforce our agreements.

Advertising & Sale of Personal Information

SRL does not sell your personal information.
SRL does not share your personal information with third parties for targeted or behavioral advertising.
SRL does not use third-party advertising pixels or similar advertising tracking technologies.
Information collected by SRL is used to operate, secure, support, administer, and improve the service as described in this Privacy Notice.

When Information May Be Shared

We may disclose information when reasonably necessary to operate SRL or comply with applicable law. This may include disclosure to:

service providers that support hosting, infrastructure, communications, payment processing, security, or other operational functions;
professional advisers such as attorneys or accountants when reasonably necessary;
government authorities, courts, law enforcement, or other parties when required by law or legal process;
parties involved in investigating fraud, abuse, security threats, or violations of our terms;
a successor organization in connection with a merger, acquisition, restructuring, financing, or sale of all or part of the business.

Service providers may receive only the information reasonably necessary for them to perform services on SRL's behalf and may also be subject to their own applicable privacy and security obligations.

Audience-Facing Information

Some information you choose to configure in SRL is intended to be displayed to your audience or other users. This may include performer names, Gig Profile information, profile images, song lists, request categories, payment links, or other information you intentionally make available through audience-facing SRL features.

You are responsible for deciding what information you choose to make available through those features.

Cookies, Sessions & Similar Technologies

SRL may use cookies, session identifiers, browser storage, or similar technologies when reasonably necessary to keep you logged in, maintain application state, remember settings, provide requested features, prevent abuse, and protect the security of the service.

Uploaded Files & Processing

When you upload a file, SRL may temporarily store and process that file in order to provide the requested feature, conversion, or import.

Certain source files may be deleted after processing while the resulting Song Note, converted content, account data, or other resulting information is retained as part of your SRL account.

Data Retention & Account Deletion

We retain information for as long as reasonably necessary to provide the service, maintain accounts and business records, comply with legal obligations, prevent fraud and abuse, resolve disputes, and enforce our agreements.

Different categories of information may be retained for different periods.

If you close your account, we will delete or de-identify associated account data within a reasonable time, except where retention is reasonably necessary or required for legal compliance, security, fraud prevention, financial or business records, backups, dispute resolution, or enforcement of our agreements.

Deleted information may remain temporarily in system backups until those backups are replaced or expire through normal system operation.

Security

We use reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, disclosure, alteration, misuse, or loss.

However, no Internet service, transmission method, software system, or storage system can be guaranteed to be completely secure.

Your Privacy Choices

You may contact SRL to request access to, correction of, or deletion of personal information associated with your account.

We may need to verify your identity before fulfilling certain requests. Some information may be retained when reasonably necessary or required by law, security requirements, fraud prevention, financial recordkeeping, dispute resolution, or other legitimate operational requirements.

Children's Privacy

Song Request Live is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

If we learn that we have collected personal information from a child under 13 without appropriate authorization, we will take reasonable steps to delete it.

Changes to This Privacy Notice

We may update this Privacy Notice from time to time as SRL, our practices, or applicable requirements change.

The current version will be posted within the service or on the applicable SRL webpage with an updated revision date.

User Agreement (Terms of Use)

By accessing, creating an account with, or using Song Request Live (“SRL”, “we”, “us”, or “the service”), you agree to the terms below.

1) Service Availability & Changes

We reserve all rights relating to the service's functions, features, content, availability, design, and operation.
The service may change, pause, be limited, or become unavailable at any time, with or without notice.
We may add, modify, discontinue, or replace features as SRL develops.

2) No Warranties (“As Is”)

To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties or guarantees of any kind.
We do not warrant that the service will always be available, uninterrupted, secure, error-free, compatible with every device, or suitable for every particular purpose.
You are responsible for maintaining appropriate backup copies of information or materials that are important to you.

3) Your Account & Responsibilities

You are responsible for your use of the service and for maintaining the confidentiality and security of your account and login credentials.
You agree to provide reasonably accurate account information.
You are responsible for activity performed through your account, except to the extent caused by SRL's own actions.
You should notify SRL if you believe your account has been compromised or used without authorization.

4) Acceptable Use

You agree not to:

use the service for unlawful, abusive, harmful, deceptive, or fraudulent purposes;
attempt to gain unauthorized access to SRL systems, another user's account, or information you are not authorized to access;
interfere with, disrupt, damage, probe, overload, or circumvent the operation or security of the service;
use automated systems, scraping tools, bots, or similar methods to access the service in a manner not authorized by SRL;
attempt to bypass account limits, security controls, access restrictions, or subscription restrictions;
introduce malware, harmful code, or other material designed to interfere with SRL or its users;
use SRL in a manner that violates applicable law or the rights of another person or organization.

5) User Content

You retain ownership of content you submit to SRL.
By submitting content, you grant SRL a non-exclusive, royalty-free, worldwide license to use, host, store, copy, process, convert, transmit, and display your content only as reasonably necessary to operate and provide the service.
Certain SRL features may require acceptance of additional terms or agreements. Those additional terms apply to your use of the applicable feature. If additional terms conflict with these Terms regarding that feature, the feature-specific terms will control.
This license ends when the applicable content is deleted from the service, subject to reasonable backup periods, legal requirements, security needs, dispute resolution, and other legitimate retention requirements.
You represent that you have the rights and permissions necessary to submit, upload, process, or display the content through SRL.
You are responsible for ensuring that your content does not violate applicable law, copyright, privacy rights, publicity rights, contractual obligations, or other third-party rights.
You are responsible for ensuring that your use of SRL and content you submit through the service comply with applicable law and do not violate third-party rights.

6) Copyright Complaints

SRL respects the intellectual-property rights of others.

If you believe content available through SRL infringes your copyright, please report it through our contact form. We will review the report and take appropriate action.

7) SRL Intellectual Property

Song Request Live, including its software, source and object code, interfaces, application design, graphics, branding, documentation, functionality, databases, and SRL-created content, is owned by SRL or its applicable licensors and is protected by applicable intellectual-property laws.

Except for the limited right to use the service in accordance with these Terms, no ownership or intellectual-property rights in SRL are transferred to you.

You may not copy, reproduce, sell, sublicense, distribute, reverse engineer, decompile, or create derivative works from SRL except where expressly authorized by SRL or where such restriction is prohibited by applicable law.

8) Paid Subscriptions & Billing

SRL may offer free and paid subscription levels with different features, usage limits, and pricing.
Paid subscriptions may renew automatically for the applicable billing period unless canceled before the next renewal date using a cancellation method provided by SRL.
By purchasing a recurring subscription, you authorize the applicable payment provider to charge the payment method associated with the transaction for recurring subscription fees until the subscription is canceled.
Subscription payments may be processed through third-party payment processors. SRL may receive transaction, subscription, payment-status, and billing information necessary to administer your account.
Prices, subscription features, and plan structures may change. Changes affecting an existing paid subscription will be handled in accordance with applicable law and any notice provided by SRL.
Cancellation stops future renewal charges but does not necessarily result in a refund for charges already incurred.
Refunds, when applicable, are governed by SRL's refund policy, purchase terms, and applicable law.

9) Audience Tips & Third-Party Payment Services

SRL may allow performers to provide payment links, usernames, QR codes, or other information for third-party payment services such as Venmo, Cash App, PayPal, Zelle, or similar services.
SRL does not process, control, or hold audience tip transactions made directly through those third-party services.
We are not responsible for third-party payment services or for payment failures, disputes, reversals, refunds, chargebacks, delays, fees, outages, account restrictions, or other transaction issues involving those services.
Your use of third-party payment services is subject to the terms, privacy policies, account requirements, and rules of those providers.

10) Third-Party Services & Links

SRL may contain links to, integrate with, or rely upon third-party websites, applications, payment providers, hosting services, communication services, or other external systems.

SRL does not control third-party services and is not responsible for their availability, security, content, business practices, terms, privacy practices, or performance.

11) Suspension & Termination

We reserve the right to suspend, restrict, or terminate access to the service when reasonably necessary because of abuse, misuse, suspected fraud, security concerns, violation of these Terms, legal requirements, nonpayment of applicable fees, or protection of SRL or others.
We may remove or disable access to content we reasonably believe violates these Terms, applicable law, or third-party rights.
You may stop using SRL at any time and may request closure of your account.
Provisions that by their nature should survive termination, including ownership, indemnification, limitations of liability, dispute provisions, and accrued payment obligations, will survive termination.

12) Feedback & Suggestions

If you voluntarily provide SRL with ideas, suggestions, feature requests, bug reports, recommendations, or other feedback relating to the service, you grant SRL the right to use that feedback without restriction or obligation to compensate you.

13) Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless SRL and its owners, operators, officers, employees, contractors, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

your use or misuse of the service;
your content;
your violation of these Terms;
your violation of applicable law;
your violation of another person's or organization's rights.

14) Limitation of Liability

To the fullest extent permitted by law, SRL shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost revenue, lost opportunities, loss of data, loss of goodwill, business interruption, or performance-related losses, arising from or related to your use of or inability to use the service, even if SRL has been advised of the possibility of such damages.

To the fullest extent permitted by law, SRL's total aggregate liability for claims arising out of or related to the service shall not exceed the amount you paid SRL during the twelve (12) months immediately preceding the event giving rise to the claim, or $50, whichever is greater.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the fullest extent permitted by applicable law.

15) Changes to These Terms

We may update these Terms from time to time. The current version will be posted within the service or on the applicable SRL webpage.

Continued use of the service after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law. When legally required, we may provide additional notice or request additional consent.

16) Governing Law & Venue

This agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or the service shall be brought exclusively in the appropriate state courts located in Bell County, Texas, or in the applicable United States federal court having jurisdiction over Bell County, Texas, and you consent to personal jurisdiction and venue in those courts.

17) Severability, Waiver & Entire Agreement

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
SRL's failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
These Terms, together with the Privacy Notice and any other policies or terms expressly incorporated by reference, constitute the agreement between you and SRL regarding your use of the service.

18) Assignment

You may not assign or transfer your rights or obligations under these Terms without SRL's prior written consent.

SRL may assign or transfer these Terms in connection with a merger, acquisition, corporate restructuring, financing, sale of assets, or transfer of the service or business.
